The Contracting Terms and Conditions regulate the distance selling relation between ticketstomatina.com and the user or customer in compliance with the legal clauses of Law 7/1998 of 13th April on Contracting Terms and Conditions ; the Law 26/1984 of 19th July on Protection of the Consumers and Users ; the Spanish Royal Legislative Decree 1906/1999 of 17th December 1999, by means of which the Terms and Conditions of E-Commerce and Telephonic Trading Rules are regulated; the Organic Act 15/1999 of 13th December on Personal Data Protection; the Law 7/1996 of 15th January on Retail Trading Planning and the Law 34/2002 of 11th July on Information Society and E-Commerce.

ticketstomatina.com reserves the right to introduce any appropriate modification on the Terms and Conditions at any time and without prior notice. These modifications may be introduced in its websites by any procedure as provided in law being mandatory for the time they are published in the web or until they are validly modified by other Terms and Conditions. Nevertheless, ticketstomatina.com reserves the right to apply, in certain cases, special or particular Terms and Conditions with priority over the present Terms and Conditions whenever they think fit, in good time and in an appropriate manner.

The aim of this webpage is to advertise and offer touristic activities of interest to you.

As user or customer you hereby expressly states that you are aware of and accept the Terms and Conditions of Use as well as the Contracting Terms and Conditions. Therefore, you declare that you are of legal age and have sufficient legal power to access to the websites which belong to ticketstomatina.com as well as contracting the services offered by those means.

To purchase any of our activities you must click on the section “Products” located in our webpage or in the outstanding tag.

It is compulsory to be registered as user of our webpage to purchase online any of our products. In compliance with the Organic Law 15/1999 on Personal Data Protection, ticketstomatina.com inform the users that the personal data collected during the process of registry and after the process of purchasing, will be included in a file under its responsibility for the purpose of dealing with these actions on behalf of the user and dealing with next actions derived from the previous ones. In compliance with the current legislation, ticketstomatina.com provides information about the available activities, their conditions and prices. Nevertheless, ticketstomatina.com reserves the right to delete or modify any of the activities offered in its webpage by simply modifying the content. Therefore, the activities offered at any time in the webpage are regulated by the Contracting Terms and Conditions which are valid in each case. The company has the right to cancel the access to the above mentioned activities without previous notice and at any time.

There are further details of our activities offered at Products where you can find the main characteristics such as: place, schedule, length, availability, minimum and maximum of people, taxes and language.
Prices
 
All activities include the selling price in Euros in which the taxes (TAV) are also included (other taxes detailed, if applicable).
Management expenses
 
ticketstomatina.com charges a variable amount of 0, 60 € as management expenses depending on the purchase price. This charge is not included in the selling price.
Payment Options and Order Process
 
The user will be able to pay the purchasing amount of money by Paypal or POS.

Once ticketstomatina.com has certified that the payment is valid, the company will send the user a PRINT-AT-HOME ticket with further details of the purchased activity. This document will be exchanged for the original ticket at the place where the activity is located. The client will get a ticket with a booking number, name and surname of the user or purchaser.

The availability of the activities offered by ticketstomatina.com can vary depending on the demand of clients. If any of the activities offered is not available, therefore it cannot be purchased. ticketstomatina.com will contact with the user by e-mail or telephone according to the data provided in the previous registry process.
Withdrawal rights and claims
 
In compliance with the Decree 20/1997 of 11th February, the Government of Valencia states:

“Article 26th. The user or consumer will be able to withdraw the requested or contracted services at any time, having the right to the return of the amounts that he/she has paid, both the price and the deposit, if any. However, the user or consumer must pay the travel agency the amounts described as follows:
a. Whereas the purchase is an independent service, both the management expenses and the cancellation fee duly justified.
b. Whereas the purchase makes reference to a whole day activity: the cancellation fee is the 15 euros, and a 100% penalty of the purchase price of the programe if the cancelation occurs less than 24H service or 7 days for Tomatina products. (GMT+1)
If you are not in time at the scheduled time of the departure where the activity starts, you will not have the right to refund the amount paid unless a force majeure you can duly prove or due to an agreement between the parties.

In the event of that any of the independent services or whole day activity was subjected to special contracting economic conditions such as aircraft charter, ships, special rates, etc. the cancellation fee due to withdrawal reasons will be imposed according to the agreements arranged by the parties.

We have to take into account the legislation on the package tours in compliance with the articles 160 and ss of the Royal Decree 1/2007 of 16th November by which the text revised of The General Law for the Protection of the Consumers and Users and other additional legislation are approved. In its article 160, the previous article 26 of the Decree on Travel Agencies of the Valencian Community is “literally” repeated as follows:

Article 160. The user or consumer will be able to declare void the requested or purchased services at any time, but the user or consumer must indemnify the organizer or the retail trader the values detailed as follows, unless this decision is made due to force majeure:

a.Payment of the management expenses, the cancellation fee (if any) and a 5% penalty of the travel purchase price, if the cancellation occurs in more than 10 days and less than 15 days prior to date of the departure. Then a 15% between the days 3 and 10, and a 25% within 48 hours prior to the departure.
If you are not in time at the scheduled time of the departure where the activity starts , the user or consumer is liable to pay the total purchase price, paying, in this case, the outstanding money unless the parties arrange an agreement.

b. In the event of that the package tour was subjected to special contracting economic conditions such as aircraft charter, ships, special rates, etc. the cancellation fee will be imposed according to the agreements arranged by the parties”.

Any complaints, objections or incidents on a particular activity must be done before 15 days from the realization of such activity. After this deadline, no claims submitted will be handled.

Legal jurisdiction
 
The relation between the user and the supplier will be regulated by the current legislation and pursuant to Spanish Law. If any dispute arises between the parties, those conflicts can be submitted to arbitration or the same Spanish jurisdiction will settle any of these disputes. ticketstomatina.com has its head office at Valencia, Spain.
